Under the USCIS-administered EB-5 (employment-based, fifth preference visa) Program, entrepreneurial investors (and their spouses and unmarried children aged 21and under) are each eligible to apply for a green card (permanent residence) if :

  1. They invest $500,000 in a commercial enterprise (such as HealO) in the United States; and

  2. The enterprise plans to create or preserve the equivalent of 10 permanent, full-time jobs for qualified U.S. workers. Congress created the EB-5 Program in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors.

In 1992, Congress created the Immigrant Investor Program, also known as the Regional Center Program. This sets aside EB-5 visas for participants who invest in commercial enterprises associated with regional centers approved by USCIS based on proposals for promoting economic growth. The EB-5 immigration program allows investors to live or retire anywhere in the U.S., to engage in any business, employment, or any other lawful activity of the investor's choice.

In 2016, there was concerted effort to raise the minimum EB-5 investment needed from $500,000 to $800,000. This effort was defeated in Congress but is likely to re-emerge. The continuation of the EB- 5 Regional Center program is subject to congressional approval each year.

The Regional Center must show the USCIS towards the end of the second year following an I-526 petition that the new commercial enterprise (such as HealO) has followed through with certain business activities that have brought about the creation of 10 or more job equivalents per investor. For a company like HealO, which will be spending millions of dollars, actively engaging in manufacturing, clinical studies and research, the economic impact will be far and wide and serve to strengthen the petitioner’s EB-5 visa application.
